The one type of home that all foreign nationals purchasing homes in the US should stay away from is, of course, the mobile home. Some properties that you want to watch out for are:
1. Nightly rentals are a no no. Banks don't like to lend on a hotel, which is basically what you are purchasing. I know alot of foreign nationals like to purchase these type of properties because everything is taken care of them but you can't get foreign national mortgage loan financing on them. If it has a credit type card for a key, instead of a metal one, it's probably bad news. You can get financing if the units are rented for at least 7 days at a time.
2. Preconstruction condos. On preconstruction high rises, 50% must be sold and 50% closed. On low rise condos it's 50% sold and 25% closed. I know that this is the most convenient home to buy because it has less upkeep but you don't want to be stuck with a condo and there are not enough homeowners to pay the homeowners association dues.
3. Stick to the tried and true single family home. US banks love them. If you're worried about keeping it up and yard work and such you can hire a property management firm to manage your home. The property management firms fee is 10% of the montly rent. They will take care of everything for you.

The California Senate has approved a bill which would give homeowners that have had part of their mortgage debt forgiven by their mortgage lenders a tax break. They will not have to pay income tax on the amount that was forgiven by their mortgage lender. This would apply to homeowners that have had a short sale, a loan modification or a mortgage loan refinance where all or part of the mortgage loan debt is forgiven.
Currently, when all or part of the mortgage debt is forgiven, the person still has to claim the amount that is forgiven as income received, which can add up very quickly. Let's say the bank forgives $50,000. $50K at a 25% tax rate is $12,500. That is a lot added onto your yearly income tax filing and just puts distressed homeowners in even worse shape. You do not want to owe the IRS. With the price of homes in CA, homeowners were probably forgiven for even larger amounts than $50K. If you're a homeowner in CA that this bill will help, please leave a comment.
This bill applies only to owner occupied homes in which the mortgage loan debt was forgiven this year or the last. This should help alot of California homeowners.
I wonder if any other states will be coming out with similar legislation. The bill in CA still needs to head to the assembly.
